In the same case referred to above, the landlord claimed for repairs to the wiring and fuses, citing that the tenant had more than the allowed number of occupants in the premises and had overloaded the circuits.
The Tribunal Member quickly dismissed this claim and stated:
“Item P seeks $400.00 compensation for damaged wiring. This claim relates to the state of the fuse box at the leased premises. Photographs were tendered. The evidence of Mr Mann was that the premises were occupied by more than the number specified in the lease and this lead to an overload on the wiring system, leading to the fuses being blown. The matter can be disposed of shortly. A tenant is not liable for the inability of the electrical wiring system of leased premises to cope with any overload of electrical equipment by a tenant and so the claim is dismissed.”
