the Landlord against the Agent, because of insufficient
information obtained in the first instance by the Agent on the
Tenancy Application Form.
Selection of a prospective tenant is crucial in demonstrating
and fulfilling a duty of care by an Agent to their Landlord.
The application must be fully completed so the Agent can
fully assess the suitability of the prospective tenant ’ which
includes actually undertaking the reference checks.
Failure to use the Tenancy Application Form for its intended
purpose, namely to assess the suitability of the tenant, would
certainly be the most common cause of litigation by
Landlords, alleging negligence on behalf of their Agent.
