IMPORTANT CLIENT UPDATE As promised please find below the latest update relating to the ongoing issue with our former employee Tracey Burnell and her company Protection and Collection Pty Ltd, not to be confused with our company Barclay MiS Protect and Collect Pty Ltd. On September 11 2009 in the Supreme Court in Queensland the Chief Justice of the Queensland Supreme Court Justice de Jersey issued orders in relation to Tracey Burnell and her company Protection and Collection Pty Ltd. Below is a brief outline of these orders, should you wish to read the entire order please click here. Summary of order - 1. Ms Burnell was to lodge with the Queensland Supreme Court an affidavit that she did not have access and could not direct anyone else to information that contained - #Customer lists; #Customer subscription information; #Customer insurance information; #Customer debt collection information; #Correspondence with customers; #Customer remittance advices; #Records or reports from the the Applicants (Barclay MiS) electronic databases #Ms Burnell lodged this affidavit on 30 September. 2.That Ms Burnell, her servants,her staff and the company can only contact customers from information that was contained in the public domain, or own personal knowledge. 3.That Ms Burnell will not make by direct comment or implication any statement or remark that is degrading, damaging, or defamatory of a personal or business nature about myself and or Barclay MiS Protect and Collect Pty Ltd (BMiS). 4.That Ms Burnell stop making reference, comment or comparison in promotional and marketing material relating to myself and (BmiS). 5.That Ms Burnell stop using the phone and facsimile numbers 03 9848 6158 and 03 9848 9653 as these were our old phone numbers for BmiS. The short version of the order is that if Ms Burnell, her company or any member of her staff or agents contact you other than by means that are in the public domain then they are in breach of the Supreme Court Order. In the event of this happening we would then be forced to make a another application to the Supreme Court in relation to this breach. Only my fellow principals who have experienced this happening to them can truly understand what you go through, you certainly experience a range of emotions, and from the many calls that I have had this is not an uncommon occurrence.
